2. Rental Agreement
All rentals are subject to a separate Rental Agreement that you will be required to sign before renting a CityOhm EV bike. This agreement will detail specific terms related to the rental period, usage, maintenance, and liability.
3. Eligibility
To rent a CityOhm EV bike, you must:
- Be at least 18 years of age.
- Possess a valid driver’s license.
- Provide accurate and complete information during the registration process.
4. Usage Restrictions
You agree to use the CityOhm EV bike only for lawful purposes and in compliance with all applicable laws and regulations. You are prohibited from:
- Using the bike for commercial purposes other than delivery services.
- Subletting or transferring the bike to another person.
- Operating the bike under the influence of alcohol or drugs.
- Tampering with or modifying the bike in any way.
5. Payment and Fees
You agree to pay all rental fees and charges as outlined in the Pricing & Plans section of our website and in the Rental Agreement. This includes:
- Daily, weekly, or monthly rental fees.
- Late return fees.
- Damage or repair costs.
- Any applicable taxes or surcharges.
6. Cancellation and Refunds
Cancellation policies and refund eligibility will be detailed in the Rental Agreement. Generally, cancellations made within a specified timeframe may be eligible for a partial refund, subject to administrative fees.
7. Maintenance and Repairs
CityOhm is responsible for the regular maintenance and repair of the EV bikes. You are responsible for reporting any mechanical issues or damage to CityOhm immediately. You are not authorized to perform any repairs yourself.
8. Liability and Insurance
CityOhm provides insurance coverage for the EV bikes as specified in the Rental Agreement. However, you are responsible for any damages or losses resulting from your negligence or misuse of the bike. You agree to indemnify and hold CityOhm harmless from any claims, damages, or liabilities arising from your use of the bike.
9. Termination
CityOhm reserves the right to terminate your rental agreement and access to our services if you violate these Terms and Conditions or the Rental Agreement. Upon termination, you must return the EV bike to CityOhm immediately.
10. Intellectual Property
All content on the CityOhm website, including logos, trademarks, and text, is the property of CityOhm Bikes Private Limited and is protected by copyright laws. You may not use, reproduce, or distribute any content without our prior written consent.
11. Limitation of Liability
CityOhm Bikes Private Limited shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of our services, even if we have been advised of the possibility of such damages.
12. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts in Mumbai.
13. Changes to Terms
